TowerScan Terms of Service

These Terms of Service ("Terms") govern your access to and use of TowerScan, including the website at towerscan.bobbycodes.dev, the TowerScan mobile applications, and the inspection services provided through them (together, the "Service"). The Service is operated by Dykes Ventures LLC ("we", "us", "our"). By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company or another organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

2. Accounts

• Accounts are created with your name, email address, and role (crew, manager, or owner). You must provide accurate information and keep it current.
• You are responsible for all activity under your account and for keeping your login credentials and email inbox secure.
• Account owners and managers may invite and remove team members, and may view inspection content created by their team. You consent to that visibility as a condition of joining a team.
• Notify us promptly at [email protected] if you believe your account has been accessed without authorization.

3. Acceptable use

You agree not to:

• Use the Service in violation of any law or regulation, or in violation of any site access agreement that applies to the property you are inspecting.
• Upload content you do not have the right to upload, including images of people who have not consented to being photographed.
• Attempt to access accounts, data, or systems that are not yours, or probe, scan, or test the vulnerability of the Service without our written permission.
• Reverse engineer, scrape, resell, or sublicense the Service, or use it to build a competing product.
• Upload malware, or interfere with the normal operation of the Service.
• Enter false, fabricated, or misleading inspection data. Inspection records may be relied on by third parties, and falsifying them may expose you to liability.

We may suspend or terminate access for conduct that violates this section.

4. Your content

You retain ownership of the inspection content you create, including photos, notes, defect reports, and GPS coordinates ("Your Content"). You grant us a limited, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate and support the Service, including backups and security review. This license ends when you delete Your Content or your account, except for copies retained in routine backups or as required by law.

You are responsible for Your Content and for having a lawful basis to collect it. You agree to defend and hold us harmless from claims arising out of Your Content or your use of the Service in violation of these Terms.

5. Subscriptions, billing, and refunds

• Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. You authorize recurring charges until you cancel.
• Prices, plan features, and limits may change. We will give notice before a price change takes effect on your plan.
• You may cancel at any time, and the cancellation takes effect at the end of the current billing period. You keep access through the period you already paid for.
• Except where required by law, payments are non-refundable, including for partial billing periods. If you believe you were charged in error, contact us within 30 days and we will review it.
• We may suspend the Service for failed payments after reasonable notice. Your data is retained during a suspension so you can restore access by resolving the payment.

6. Service availability and support

We aim to keep the Service available and functional but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, change features, or discontinue parts of the Service. If we discontinue the Service entirely, we will give at least 30 days notice and a reasonable opportunity to export your data.

7. Mobile applications

The TowerScan mobile applications are licensed to you for use with the Service, not sold. Distribution through the Apple App Store and Google Play is also subject to those platforms' terms, and their operators are not responsible for the Service or for supporting it.

8. Our property

The Service, including its software, design, trademarks, and documentation, is owned by us or our licensors and is protected by intellectual property law. These Terms give you a limited, revocable, non-transferable right to use the Service. No other rights are granted.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT INSPECTION DATA WILL BE ACCURATE OR COMPLETE. You are responsible for independently verifying inspection findings before relying on them for any safety, regulatory, or commercial decision.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Termination

You may stop using the Service at any time and request deletion of your account. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Sections covering your content license, disclaimers, limitation of liability, and governing law survive termination.

12. Data and privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these Terms. Deletion requests may be sent to [email protected].

13. Changes to these Terms

We may update these Terms. If a change is material, we will notify account holders by email before it takes effect. Continued use after the effective date means you accept the updated Terms. The current version is always at this URL.

14. Governing law and disputes

These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of law rules. The parties will attempt to resolve any dispute informally by written notice and 30 days of good faith discussion. If that fails, the dispute will be resolved in the state or federal courts located in Louisiana, and each party consents to venue and personal jurisdiction there. Each party waives any right to a jury trial to the extent permitted by law.

15. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
